REASON FOR REQUEST: <br />The existing property has unique site conditions which restrict the buildable area on the lot. The property is subject to <br />watershed regulations due to the nearby Klawitter Pond, requiring finished floor elevations above 976.8 feet. <br />Additionally, City Code section 105.12.670 (c) requires that accessory structures be located no nearer to the front lot line <br />than the principal building. The elevation requirement, the location of the existing septic system, and city code setback <br />requirements restrict the buildable area where an accessory structure may be placed. <br />It should be noted that in the case of a corner lot, City Code defines the front lot line as the boundary with the shortest <br />dimension which abuts a public street. In the case of the Subject Property, the front lot line is determined to be Keats <br />Avenue. <br />Below are tables of the Residential Estate Setbacks and Impervious Limits (LEC 105.12.670 & LEC 105.12.630), the <br />existing home setbacks and impervious area, and the proposed setbacks and impervious area: <br /> Residential Estate Zoning Proposed Structure <br />Front Yard Setback (accessory <br />structure) <br />No closer to the front lot line (Keats Ave) than <br />the primary structure: 143.7 ft 98.7 ft <br /> <br />The existing property exceeds the 15% maximum impervious area for the Residential Estate zoning district.
