CITY OF LAI{E ELMO <br />WASHINGTON COUNTY <br />STATE OF MINNESOTA <br />RESOLUTION NO. 2026-046 <br />A RESOL UTIONAPPROVING THE FIRST AMENDMENT TO THE DEVELOPMENT <br />AGREEMENT FOR 10TH AND LAKE ELMO SCHOOL ADDITION <br />WHEREAS, the City of Lake Elmo is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, Stillwater Area Schools, Independent School District 834, (the "Applicant") <br />has previously submitted an application to the City of Lake Elmo (the "City") for a final plat for <br />10a' and Lake Elmo School Addition; and <br />WHEREAS, the Lake Elmo City Council adopted Resolution No 2025-015 on February <br />4"' 2025 approving the final plat for loth and Lake Elmo School Addition; and <br />WHEREAS, the Lake Elmo City Council adopted Resolution No 2025-031 on March 18th <br />2025 approving the Development Agreement for 10th and Lake Elmo School Addition; and <br />WHEREAS, the Applicant and the City have agreed to amend the Development <br />Agreement for 10 and Lake Elmo School Addition a first time in order to allow a temporary <br />certificate of occupancy to be issued by the City prior to City approval and acceptance of the <br />Subdivision Improvements as described in the staff report to City Council dated July 7, 2026; and <br />NOW, THEREFORE, based on the information received, the City Council of the City of <br />Lake Elmo does hereby approve the First Amendment to Development Agreement for loth and <br />Lake Elmo School Addition, authorize the City Attorney to draft the First Amendment to the <br />Development Agreement to include provisions to allow issuance of a temporary certificate of <br />occupancy prior to City approval and acceptance of the Subdivision Improvements as proposed in <br />the staff report dated July 7, 2026, and authorize the Mayor and City Clerk to execute the First <br />Amendment to Development Agreement. <br />Passed and duly adopted this 11� day of J'O M 026 by the City Council of the City of <br />Lake Elmo, Minnesota. <br />atLq-�.- <br />Charles Cadenhead, Mayor <br />AT T: <br />L <br />Jule Jo son, ' y erk <br />
