CITY OF LAKE ELMO <br />WASHINGTON COUNTY <br />STATE OF MINNESOTA <br />RESOLUTION NO. 2026-047 <br />A RESOL UTION APPR 0 VING THE FIRST AMENDMENT TO THE DEVELOPMENT <br />AGREEMENT FOR OAK -LAND MIDDLE SCHOOL ADDITION <br />WHEREAS, the City of Lake Elmo is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, Stillwater Area Schools, Independent School District 834, (the "Applicant') <br />has previously submitted an application to the City of Lake Elmo (the "City") for a minor <br />subdivision for Oak -Land Middle School Addition; and <br />WHEREAS, the Lake Elmo City Council adopted Resolution No 2024-105 on October <br />1st, 2024 approving the minor subdivision for Oak -Land Middle School Addition; and <br />WHEREAS, the Applicant and the City have agreed to amend the Site Improvement <br />Agreement for Oak -Land Middle School Addition a first time in order to allow a temporary <br />certificate of occupancy to be issued by the City prior to City approval and acceptance of the Site <br />Improvements as described in the staff report to City Council dated July 7, 2026; and <br />NOW, THEREFORE, based on the information received, the City Council of the City of <br />Lake Elmo does hereby approve the First Amendment to the Site Improvement Agreement for <br />Oak -Land Middle School Addition, authorize the City Attorney to draft the First Amendment to <br />the Site Improvement Agreement to include provisions to allow issuance of a temporary certificate <br />of occupancy prior to City approval and acceptance of the Site Improvements as proposed in the <br />staff report dated July 7, 2026, and authorize the Mayor and City Clerk to execute the First <br />Amendment to Site Improvement Agreement. <br />Passed and duly adopted this day of d 14(m_2026 by the City Council of the City of <br />Lake Elmo, Minnesota. <br />&44t6U�1_ <br />Charles Cadenhead, Mayor <br />ATTEST: <br />Jul e Jo ms _( ty Clerk -' <br />
