RESOLUTION NO. 91 -15 <br />CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION VACATING AN EASEMENT OVER AND ACROSS THE <br />WESTERLY EIGHT (8) FEET OF LOT 14 -, BLOCK 3, <br />DEMONTREVILLE HIGHLANDS 4TH ADDITIOr? <br />WHEREAS, at a regular meeting of the City Council of the City of Lake <br />Elmo, Washington County, Minnesota, held on May 21, 1991, a Petition <br />was presented to the City Council praying for the vacation of a <br />certain eight (8) foot easement in the Plat of DeMontreville Highlands <br />4th Addition described as follows: <br />The westerly eight (8) feet of Lot 14, Block 3, <br />DeMontreville Highlands 4th Addition, <br />WHEREAS, said Petition came on for hearing before said City Council at <br />a regular meeting thereof on Tuesday, May 21, 1991 in the City Hall <br />pursuant to Notice thereof published and posted. as required by law, <br />and <br />WHEREAS, that part of Lot 14, Block 3 DeMontreville Highlands Ath <br />Addition has never been open or used for pedestrians as a means of <br />ingress and egress to DeMontreville Park, and. it is impro "ruble there <br />will ever be any public need. for said easement; moreover, by vacating <br />the sane, the property will be returned to the tax rolls ara ' Would the taxable value of the land abutting thereon or affected. <br />there'n�: ; and <br />WHEREAS, for the foreaoina reasons, it appears to be in the pul -Ilic <br />interest to vacate said easement. <br />NOW, THEREFORE, BE IT RESOLVED, that the eight (8) foot easement <br />dedicatee;. in the plat of DeMontreville Highlands 4th Addition <br />described above be, and the sane hereby is, vacated.. <br />BE IT FURTHER RESOLVED, that the Clerk shall prepare a Notice of <br />Completion of these proceedings which shall contain the name of the <br />City, and the identification of the vacation, a statement of the time <br />of completion thereof and. a description of the real estate and land <br />affected there?rJ, Such Notice shall be presented. to the Washington <br />County Auditor who shall enter the same in his transfer records and <br />note upon the instrun.e,it over his official signature the words <br />"entered in the transfer records ".
