RESOLUTION NO. 92-30 <br />OF THE CITY OF LAKE ELMO <br />TO IDENTIFY IN SHORELAND AREAS <br />NON - CONFORMING SEWAGE TREATMENT SYSTEMS <br />AND REQUIRE RECONSTRUCTION WHEN PRACTICABLE <br />WHEREAS, the Lake Elmo City Council has adopted shoreland regulations <br />consistent with the Minnesota Department of Natural Resources Statewide <br />Standards for Management of Shoreland Areas; and <br />WHEREAS, said statewide shoreland management standards require that local <br />governments develop and implement programs to identify and upgrade sewage <br />treatment systems that are not in conformance with Minnesota Pollution Control <br />Agency Rules, Chapter 7080; and <br />WHEREAS, the Lake Elmo City Council finds that protecting the surface waters <br />and groundwaters in Lake Elmo from contamination by substandard sewage <br />treatment systems will promote the health and welfare of the citizens of Lake <br />Elmo. <br />NOW, THEREFORE, BE IT RESOLVED, that Lake Elmo will take the following actions <br />to identify and upgrade substandard sewage treatment systems: <br />1. Through Chapter 700 of the City Code, a maintenance program is in <br />place, which involves a systematic inspection and review of existing <br />on -site sewer systems and the repair or reconstruction if determined <br />to be needed. <br />2. Whenever a permit or variance of any type is required for any <br />improvement on, or use of, property in a shoreland area, a report will <br />be required on the working condition and operation of the sewage <br />treatment system. Systems not meeting the current design standards <br />will be required to be modified or reconstructed. <br />3. As state shoreland implementation funds become available, the City <br />will complete a systematic on -site inspection program, including all <br />properties in shoreland areas and identifying non - conforming or <br />illegal on --site sewer systems and requiring reconstruction when <br />appropriate. <br />Passed this 15th day of DecembE <br />ATTEST: <br />tGf1t <br />__ ary K effne., City Administrator <br />
