RESOLUTION 93-40 <br />WHEREAS, the City Council of the City of Lake Elmo has previously considered <br />and approved the preliminary plat of Rolling Hills, hereinafter referred to as Rolling <br />Hills Estates; and <br />WHEREAS, the Lake Elmo Planning Cornn- 6sbion reviewed-a fixral- plat for <br />Rolling Hills Estates at its November 23, 1992 meeting; and <br />WHEREAS, the final plat of Rolling Hills Estates presented to the City conforms <br />to the City's subdivision ordinance. <br />NOW, THEREFORE BE IT RESOLVED that the City Council of the City of <br />Lake Elmo does hereby approve and accept the final plat of Rolling Hills as the same as <br />on file with the City Administrator, subject to the following conditions: <br />1. The developer and the City shall execute a developer's agreement and <br />developer shall deposit such security with the City in the amount of <br />$288,750 as determined by the City Engineer. <br />2. The developer shall pay to the City of Lake Elmo Park Dedication fee <br />in the amount of $8,855. <br />3. The developer shall provide a title binder for Rolling Hills Estates to the City <br />Attorney for review and approval. <br />4. The developer provide a legal description for the outlet road from Rolling <br />Hills Estates thru Fox Fire Manor to the City Attorney so an easement can be <br />prepared, and said easement mus t: be signed by all record owners or parties <br />who have a mortgagee's interest. <br />5. Developer will comply with all requirements set forth in Valley Branch <br />Watershed Permit. <br />b. Outlot A be dedicated to the City of Lake Elmo for future use as road <br />frontage for future lots or park uses as the City determines. <br />
