RESOLUTION 93-40 WHEREAS, the City Council of the City of Lake Elmo has previously considered and approved the preliminary plat of Rolling Hills, hereinafter referred to as Rolling Hills Estates; and WHEREAS, the Lake Elmo Planning Cornn- 6sbion reviewed-a fixral- plat for Rolling Hills Estates at its November 23, 1992 meeting; and WHEREAS, the final plat of Rolling Hills Estates presented to the City conforms to the City's subdivision ordinance. NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Lake Elmo does hereby approve and accept the final plat of Rolling Hills as the same as on file with the City Administrator, subject to the following conditions: 1. The developer and the City shall execute a developer's agreement and developer shall deposit such security with the City in the amount of $288,750 as determined by the City Engineer. 2. The developer shall pay to the City of Lake Elmo Park Dedication fee in the amount of $8,855. 3. The developer shall provide a title binder for Rolling Hills Estates to the City Attorney for review and approval. 4. The developer provide a legal description for the outlet road from Rolling Hills Estates thru Fox Fire Manor to the City Attorney so an easement can be prepared, and said easement mus t: be signed by all record owners or parties who have a mortgagee's interest. 5. Developer will comply with all requirements set forth in Valley Branch Watershed Permit. b. Outlot A be dedicated to the City of Lake Elmo for future use as road frontage for future lots or park uses as the City determines.
