CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION 95-52 <br />A RESOLUTION DEFERRING THE $842.13 ASSESSMENT AGAINST LOT 11 BERSCHENS SHORES <br />(PLATE AND PARCEL No. 37090 -2500) AS REQUESTED BY MARGARET E. PAUL <br />FOR THE 1995 OVERLAY OF JANE ROAD NORTH <br />WHEREAS, MARGARET E. PAUL, THE OWNER OF RECORD OF LOT I I BERSCHENS SHORES, <br />COMMONLY KNOWN AS 9369 JANE ROAD NORTH, (PLATE AND PARCEL No. 37090 -2500) HAS REQUESTED A <br />DEFERMENT OF THE $842.13 ASSESSMENT FOR THE 1995 IMPROVEMENT OF JANE ROAD NORTH; AND <br />MONTH. <br />WHEREAS, MARGARET PAUL IS 84 YEARS OF AGE AND LIVES ON A FIXED INCOME OF $400 PER <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL DETERMINES A HARD SHIP TO EXIST <br />FOR .MARGARET E. PAUL, AND DEFERS THE ASSESSMENT OF $842.13 AGAINST SAID PROPERTY. <br />BE IT FURTHER RESOLVED THAT SAID DEFERMENT SHALL ACCRUE INTEREST AT THE RATE OF 8 <br />PERCENT PER YEAR UNTIL PAID. <br />BE IT FURTHER RESOLVED THAT SAID DEFERRED ASSESSMENT SHALL TERMINATE AND ALL <br />PRINCIPLE AND INTEREST BECOMES DUE AND PAYABLE UPON THE OCCURRENCE OF ANY OF THE FOLLOWING <br />EVENTS: <br />(1) THE DEATH OF MARGARET E. PAUL IF THERE IS NO SPOUSE WHO IS ELIGIBLE FOR DEFERMENT. <br />(2) THE SALE, TRANSFER, OR SUBDMSION OF THE PROPERTY OR ANY PART THEREOF. <br />(3) THE PROPERTY SHOULD LOSE IT'S HOMESTEAD STATUS. <br />(4) THE CITY COUNCIL SHOULD DETERMINE THAT THE HARDSHIP NO LONGER EXISTS.
