CITY OF LAKE ELMO <br />RESOLUTION 96-36 <br />WHEREAS, on February 14, 1984, the Lake Elmo City Council entered into a <br />Development Agreement which included the dedication of an easement over a portion of Lot 16, <br />Three Lake Farm Addition; and <br />WHEREAS, the Development Agreement was recorded in the Office of the Washington <br />County Recorder on April 12,1985, as Document No. 482858; and <br />WHEREAS, the Development Agreement legally described the easement as follows: <br />That part of Lot 16 of Three Lakes Farm Addition according to the plat on file in the <br />office of the County Recorder, Washington County, Minnesota described as follows: <br />The West 120.00 feet of the East 390.00 feet of Lot 16, Three Lakes Farm <br />Addition, as measured at a right angle to the East line of the Southwest 1/4 of <br />Section 8, Township 29 North, Range 21 West, Washington County, Minnesota. <br />("Easement"); and <br />WHEREAS, a petition was filed to vacate the Easement and the hearing on the petition <br />was held before the Lake Elmo City Council at a regular meeting thereof at 7:00 p,m. on <br />Thursday, November 7, 1996, in the Lake Elmo City Hall pursuant to the provisions of Minn. <br />Stat. 412.851; and <br />WHEREAS, the Lake Elmo City Council has determined that the Easement no longer <br />serves a public purpose for the following reasons: <br />An improved road through Lot 16, Three Lakes Farm <br />Addition will not be needed in the future. <br />2. The Easement indicated will not serve a public purpose. <br />3. Due to the elevations on Lot 16, Three Lakes Farm Addition, it would <br />be difficult to extend a road through this property. <br />4. There are other ways to serve the property by a publicly dedicated <br />access in the future. <br />
