CITY OF LADE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 98- 28 <br />A RESOLUTION ORDERING IMPROVEMENT, PREPARATION OF PLANS, <br />AND APPROVING PLANS AND SPECIFICATIONS AND <br />ORDERING ADVERTISMENT FOR BIDS <br />FOR THE 1998 OVERLAY PROJECT <br />WHEREAS, the City Council on April 7, 1998 fixed a date for a Council hearing on the proposed <br />improvement of- <br />1998 OVERLAYS <br />1. STILLWATER LANE <br />2. 10' STREET LANE <br />3. JAMLEY AVENUE NORTH <br />4. JANE COURT NORTH <br />5. 33RD STREET LANE <br />6. HILL TRAIL NORTH <br />7. 33RD STREET AND LAVERNE AVENUE NORTH <br />8. FIRE STATION AND PARK DEPT. LOTS <br />WHEREAS, ten days' mailed notice and two weeks' published notice of the hearing was given, and the <br />hearing was held thereon the P d.ay of May, 1998, at which all persons desiring to be heard were given an <br />opportunity to be heard thereon. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKE ELMO, <br />MINNESOTA: <br />I . Such improvement is necessary, cost - effective, and feasible as detailed in the feasibility report. <br />2. Such improvement is hereby ordered as proposed in the Council resolution adopted May 5, 1998. <br />3. PIans and specifications have already been prepared by Tom Prew, TKDA, engineer for such <br />improvement and pursuant to Council resolution, a copy of which plans and specifications is <br />attached hereto and made a part hereof, are hereby approved and shall be filed with the City Clerk. <br />4. Th City Clerk shall prepare and cause to be inserted in the official paper and in the Construction <br />Bulletin an advertisement for bids upon the making of such improvement under such approved <br />plans and specifications. The advertisement shall be published for two weeks, shall specify the work <br />to be done, shall state that bids will be opened and considered by the Council at on May 29, <br />1998, in the Council chambers of the City Hall, and that no bids will be considered unless sealed <br />and filed with the clerk and accompanied by a cash deposit, cashier's check, bid bond, or certified <br />check payable to the clerk for 5% of the amount of such bid. <br />ADOPTED BY THE COUNCIL this 5s' day of May, 1998. ,:1" � <br />W}IdJo n,—A ay <br />ATTEST: <br />Mary ef�e4 ,,City Adm` fstrator� <br />
