CITE' OF LAKE ELMO <br />Washington County, Minnesota <br />Resolution Noe 99 -84 <br />A RESOLUTION APPROVING A NON - CONFORMING USE FOR <br />STEPHEN JOHNSON <br />WHEREAS, the Lake Elmo City Council has reviewed and heard testimony <br />regarding the proposed non - conforming use of storage and parking reoriented on the site <br />owned by Stephen Johnson will be no more detrimental to adjacent parcels than its <br />current non - conforming use of storage and parking on the following property: <br />The property is located at Upper 33rd Street, east of Lake Elmo <br />Avenue and north of the Union Pacific Railroad Tracks <br />identified as Geo Code 13- 029 -21 -32 -0088. <br />NOW, THEREFORE, BE IT RESOLVED THAT the Lake Elmo City Council <br />does hereby make the following findings concerning said determination: <br />1. The existing storage is a legal non - conforming use of the site. <br />2. The substitution of the non - conforming use of storage and parking <br />On a different location on the site is no more detrimental to its <br />neighborhood and surroundings than the use it is to replace. <br />3. Subject to the approval of the site plan. <br />BE IT FURTHER RESOLVED, that the Lake Elmo City Council hereby <br />determines the existing storage is a legal non - conforming use of the site and the <br />substitution of the non - conforming use is no more detrimental to the adjacent parcels than <br />its current non - conforming use of storage and parking as required by the Code. <br />ADOPTED by the Lake Elmo City Council the 16th day of November, 1999. <br />Lee Hunt, Mayor <br />ATTEST: <br />Mary ue nr, City inistrator <br />
