City of Lake Elmo <br />Washington County, Minnesota <br />Resolution No. 99- 93 <br />A RESOLUTION RELATING TO HELMO AVENUE EXTENSION LAYOUT APPROVAL <br />WHEREAS, the City of Lake Elmo (Lake Elmo) and the City of Oakdale (Oakdale) share <br />a common corporate boundary line; and <br />WHEREAS, Oakdale desires to extend a portion of Helmo Avenue from Hydram Avenue <br />to the intersection of Stillwater Boulevard and Ideal Avenue; and <br />WHEREAS, a portion of the right -of -way and roadway segment of Helmo Avenue will <br />encroach into that portion of Lake Elmo as depicted on the attached Proposed Improvement Plan <br />prepared by SEH, Incorporated; and <br />WHEREAS, Oakdale has requested Plan Layout approval from the City Council of Lake <br />Elmo; and <br />WHEREAS, Lake Elmo and Oakdale desire to enter into a Cooperative Agreement for <br />maintenance, construction, and right -of -way acquisition. <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of the of Lake Elmo does <br />hereby approve the Plan of the Road Extension as depicted on the attached Plan prepared by <br />SEH, Incorporated dated October 29, 1999; and <br />NOW, THEREFORE, BE IT FURTHER RESOLVED, that the City Council of the City <br />of Lake Elmo agrees to enter into a Cooperative Agreement relating to the maintenance, <br />construction and right-of-way acquisition for the Helmo Avenue extension, provided that nothing <br />in the agreement shall obligate the City of Lake Elmo to pay any costs. <br />Adopted this 21st day of December, 1999, by the Lake Elmo City Council. <br />Lee Hunt, Mayor <br />Attest: <br />Aa-4- <br />Mary Kueffner, City Administrator <br />0543958.01 <br />
