CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 99- 44 <br />A RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR <br />(4) FOUR SINGLE FAMILY DETACHED UNITS FOR THE PREVIOUSLY APPROVED <br />SINGLE FAMILY ATTACHED UNITS IN TAMARACK FARM ESTATES <br />WHEREAS, the Lake Elmo City Council adopted a Conditional Use Permit for Eight Single <br />Family Attached Units in Tamarack Farm Estates on August 19,1997, <br />WHEREAS, the Lake Elmo Planning Commission considered a request by Jon Whitcomb, the <br />developer, to amend the Conditional Use Permit regarding Single Family Attached Units instead to allow <br />Single Family Detached Units. <br />WHEREAS, the Lake Elmo Planning Commission at a Public Hearing on July 12, 1999 reviewed <br />and recommended approval of an amendment to the Conditional Use Permit/OP Plan to substitute Four <br />Single Family Detached Units, Block 1, Lots 1,2,3,4 on Tamarack Farm Estates Second Plat, based on the <br />following findings: <br />I. The proposed amendment to the OP Plan and Conditional Use Permit continues to be in <br />compliance with the OP Ordinance and Comprehensive Plan. <br />2. The proposed amendment to the Preliminary Plat is in compliance with both Chapter 300 <br />(zoning standards), and Chapter 400 (platting standards). <br />WHEREAS, the Lake Elmo Planning Commission recommended approval of the <br />amendment of the Conditional Use Permit as follows: <br />1. All applicable conditions of the August 19, 1997 OP Development Plan and Conditional Use <br />Permit approvals are complied with. <br />2. Ownership of Outlot A shall be the Tamarack Homeowners Association or such other entity <br />as approved by the City Attorney. <br />3. Outlot A shall be subject to an Open Space Conservation Easement running to the Minnesota <br />Land Trust or the City in a form to be approved by the City Attorney. <br />NOW, THEREFORE, BE IT RESOLVED, that the Lake Elmo City Council does <br />hereby approve an amendment to the Conditional Use Permit, adopted by the Council on August 19, 1997, <br />to substitute Four Single Family Detached.
