CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 99 -28 <br />A RESOLUTION SETTING CONDITIONS PRIOR TO RELEASE AND <br />RECORDING OF THE WATERS BAY FINAL PLAT <br />WHEREAS, the City Council approved the Final Plat of the Waters Bay <br />subdivision by resolution No. 99 -27 on April 20, 1999, <br />WHEREAS, said approval was subject to conditions to be satisfied prior to <br />release and recording of Final Plat documents by the City; <br />NOW, THEREFORE, BE IT RESOLVED, that the Final Plat mylars and <br />certified copy of Resolution No. 99- 27 shall be released by the City- to the developer <br />only upon compliance with the following conditions: <br />1. Payment of Park. Dedication Fees in accordance with Section 400 of the <br />City Code in the amount of $1,500. <br />2. Compliance with applicable requirements of the City Engineer's Review <br />Letter of February 4, 1999, <br />3. Submission of an easement for driveway access to Lot 1 specifying that <br />said access serve both Lots 1 and 2 at the point of intersection with Labe <br />Jane Trail; as illustrated in EXHIBIT A, signed by the City Planner on <br />April 20, 1999; subject to landscape planting of (6) six foot spruce and (6) <br />two foot spruce at the south driveway for maximum shielding. <br />4. Transfer of outlots to the adjoining property owners are to be completed <br />and recorded prior to issuance of any building permits by the City. <br />ADOPTED, by the Lake Elmo City Council this 20"' day of April, 1999, <br />Lee Hunt, Mayor <br />ATTEST: <br />Ma '!!!!r I ud, er, City Administrator <br />
