City of Lake Elmo <br />Washington County, Minnesota <br />RESOLUTION NO. 2000-041 <br />A RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR A <br />NON- AGRICULTURAL. LOW IMPACT USE ON THE ARMSTRONG- FARM AND <br />RESCINDING RESOLUTION 88 -16. <br />WHEREAS, Thomas G., Thomas P., and ,Jodi M. Armstrong (herein applicant), are the fee <br />owners of approximately 264.6 acres of land (herein applicant property), located in the City of Lake <br />Elmo (herein City), is illustrated. on Exhibit "A' attached, and is legally described as follows: <br />The following described Two Hundred Sixty -four and Six Tenths (264.6) acres, more or less, of real <br />estate located in Section Twenty-eight (28), Township twenty -nine North (29N), Range Twenty -one <br />(21W), City of Lake Elmo, County of Washington, State of Minnesota; to wit: <br />The Northwest Quarter (NW F /a), of Section Twenty -eight (28), containing one - hundred and sixty <br />(160) acres, more or less; and <br />The Northwest Quarter (NM 1/4) of the Southwest Quarter (SW } /a), Section Twenty -eight (28), <br />except the westerly Seven Hundred Eighty (780) feet thereof, and except the following described <br />parcel; to wit: <br />Commencing at the Northwest W corner of the Southwest Quarter (SW 1 /a) of Section Twenty- <br />eight (28), thence east along the north line of said Southwest Quarter (SW 1 /a) for Seven Hundred <br />Eighty (780) feet to the point of beginning of this exception; thence continuing east along said north <br />line of the Southwest Quarter (SW 1 /a) for One Hundred Sixty (160) feet; thence south at right angles <br />for Three - Hundred Sixty feet; thence west at right angles for One Hundred Sixty (160) feet; thence <br />north at right angles for Three - Hundred sixty (360) feet to the point of beginning. Said exception <br />containing one and thirty -two hundredths (1.32) acres, more or less, and subject to the right -of -wayof <br />151h Street North; containing fourteen and Six tenths (14.6) acres, more or less; and <br />The East Half (E �i) of the Southwest Quarter (SW ' /a), of the southwest Quarter (SW 1 /a), of Section <br />Twenty -eight (28), containing twenty (20) acres, more or less; and <br />The East half (E 1h) of the Southwest Quarter (SW' /), except for the Northeast Quarter (NE 1/4) of <br />the Northeast Quarter (NE ' /a) of the Southwest Quarter (SW ' /a), of Section Twenty -eight (28), <br />containing seventy (70) acres, more or less. <br />WHEREAS, applicant has requested a Conditional Use Permit, which would specifically <br />apply to approximately 10 acres of the applicant's property (the CUP Area) which is illustrated on <br />attached Exhibit "B ", and which is legally defined as follows: <br />That part of the Southwest Quarter (SW ' /a) of Section Twenty-eight (28), Township twenty-nine <br />North (29N), Range twenty-one West (21W), Washington County, State of Minnesota, described as <br />follows: <br />Commencing at the north east corner of the West half of the Southwest Quarter of said Section 28; <br />thence South 00 degrees 18 minutes 22 seconds West, assumed bearing along the east line of side <br />
