CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 2001-039 <br />WHEREAS, the Lake Elmo Council approved the Final Plat of LAKE ELMO <br />VISTA by Resolution No. 2001 -038 on June 5, 200 1, and <br />WHEREAS, said approval was subject to conditions to be satisfied prior to release <br />and recording of Final Plat documents by the City; <br />IOW, THEREFORE, BE IT RESOLVED, that the Final Plat mylars and <br />certified copy of Resolution No. 2001 - shall be released by the City to the developer only <br />upon compliance with the following conditions. <br />1. Compliance with the recommendations of the City Engineer and City Attorney. <br />2. Consent of the property owner approved as to form by the City Attorney for any <br />off -site grading. <br />3. The City Engineer has reviewed and approved the Final Plat Mylars; and, all fees <br />and development security specified by the Development Agreement have been <br />remitted to the City. <br />4. The Landscape Plan dated February 9, 2001 shall be amended to reflect the 104 <br />trees proposed to be added to the site (in addition to boulevard trees) be located <br />in such a manner as to be evenly distributed upon the 8 lots on which no existing <br />trees are now located — 13 new trees per lot. <br />ADOPTED by the Lake Elmo City Council this 5`h day of June, 2001. <br />Lee hunt, Mayor <br />Ma�ICzffner, . -'Administrator <br />A <br />
