CITY OF LAKE ELMO RESOLUTION NO, 2004-036 <br />WEST LAKELAND TOWNSHIP RESOLUTION NO. <br />JOINT RESOLUTION FOR ORDERLY ANNEXATION <br />I N THE MATTER OF THE JOINT RESOLUTION CF THE CITY OF LAKE ELI O AND <br />THE TOWNSHIP OF WEST LAKELAND DESIGNATING AN UNINCORPORATED <br />AREA AS IN NEED OF ORDERLY ANNEXATION AND CONFERRING <br />JURISDICTION OVER SAID AREA TO THE DEPARTMENT OF ADMINISTRATION <br />PURSUANT' TO M.S. 414.0325 <br />WHEREAS, the following 3.7 acre portion of the Township of West Lakeland <br />("West Lakeland"), which is illustrated on Exhibit A attached, abuts the City of Lake <br />Elmo ("Lake Elmo"), and primarily includes the right-of-way for Manning Trail: <br />An area bounded by the west section line of Section 19, Township 29, <br />Range 20, Washington County, Minnesota; by the west line of Downs <br />Lake 2"d Addition; by the north line of the south half of the south half of <br />said Section 19; by the centerline of C,S.A.H. 15; and by a line lying 400 <br />feet north of and parallel to the north line of the south half of the south half <br />of said Section 19 ("Annexation Area"); and <br />%9AWIFIEREA—S, the a,nnexafion of the Annexation Area would allow Lake. Elmo to <br />connect an existing municipal state aid road to an existing county state aid highway <br />thereby allowing the Lake Elmo to become eligible for state aid reimbursement for <br />ongoing maintenance and future street improvement work on Manning Trail, and <br />WHEREAS, Lake Elmo and West Lakeland agree that the Annexation Area is in <br />need of orderly annexation; and <br />WHEREAS, Lake Elmo and West Lakeland agree that no alteration of the <br />boundaries of the Annexation Area is appropriate; <br />NOW, THEREFORE, BE IT RESOLVED that Lake Elmo and West Lakeland <br />agree that no consideration by the Department of Administration is necessary, and <br />further agree that upon receipt of this Resolution, passed and adopted by each party, <br />the Department of Administration may review and comment, but shall, within thirty (30) <br />days, order the annexation of the Annexation Area in accordance with the terms of this <br />joint resolution, <br />
