CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 2004- 038 <br />A RESOLUTION APPROVING A. SITE PLAN FOR AN ADDITION <br />TO RETAIL CONSTRUCTION <br />WHEREAS, George Middleton, Excel Partners, (Retail Construction), has made <br />application for a Section 520 Site Plan for a 4,000 square foot addition to the existing <br />structure at the southeast corner of Laverne Avenue and 39' Street North, <br />WHEREAS, at its April 26, 2004 meeting, the Lake Elmo Planning Commission <br />recommended approval of the 520 Site Plan for an addition to the structure at 11343 39th <br />Street North per plans staff dated April 22, 2004, <br />WHEREAS, at its May 4, 2004 meeting, the Lake Elmo City Council reviewed <br />the application for a 4,000 square foot addition to the existing structure located at 11343 <br />39t" Street North. <br />NOW, THEREFORE, BE IT RESOLVED that the Lake Elmo City Council <br />approves the application of a Section 520 Site Plan application made by George <br />Middleton, Excel Partners, (Retail Construction), for a 4,000 square foot addition to the <br />existing structure at 11343 39h Street North, per plans staff dated April 22, 2004, subject <br />to the following condition: <br />1. That the secondary drain field be modified as to location to be not <br />less than 20 feet from the structure. <br />ADOPTED, by the Lake Elmo City Council on the 4th day of May, 2004. <br />Lee Hunt, Mayor <br />ATTEST: <br />Charles E.
