CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA RESOLUTION NO. 2004-107 A RESOLUTON RELATING TO THE VACATION OF PORTIONS OF 55TH STREET NORTH WHEREAS, the City received a request that certain platted unimproved portions of 55`" Street North be vacated; WHEREAS, the City conducted a public hearing pursuant to Minnesota Statutes 412.851 and received comments from interested parties; and WHEREAS, the Lake Elmo City Council has determined that it is in the public's interest to vacate the following described platted, but unimproved portions of 55 Street North, Lake Elmo, Minnesota. NOW, THEREFORE, BE IT RESOLVED, that the following street segments and utility and drainage easements are hereby vacated as illustrated in Exhibit A and legally described as: Street Segment That portion of 55`x' Street North lying easterly of the northerly extension of the west line of Lot 10 Block 4, Carriage Station Addition, and westerly of the municipal boundary between the City of Lake Elmo, Minnesota and the City of Oak Park Heights, Minnesota. Drainage and Utility Easement The 10 foot wide rear yard drainage and utility easement, excluding the 5 feet adjacent to each side lot line, on Lot 3 through 9, Block 4, Carriage Station Addition; and, the 25 foot wide rear yard drainage and utility easement, excluding the 5 feet adjacent to each side lot line, on Lots 1 and 2, Block 4, Carriage Station Addition. Subject to: 1. Conveyance to the City of a drainage and utility easement over the entire vacated portion of the right-of-way prior to recording of this Resolution 2. Conveyance to the City of a 20 foot wide trail easement centered over the centerline of 55h Street North opposite Lots 3 through 8, Block 4 Carriage Station Addition, and a 20 foot wide trail easement south of the centerline of 55 Street North opposite Lots 1, 2, and 9, Block 4, Carriage Station Addition prior to recording of this Resolution. 3. Conveyance of driveway easements as required to access the properties north of the vacated street from the center line of the vacated street to the north line of the vacated street prior to recording of this resolution.
