CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 2004-107 <br />A RESOLUTON RELATING TO THE VACATION OF PORTIONS OF <br />55TH STREET NORTH <br />WHEREAS, the City received a request that certain platted unimproved portions <br />of 55`" Street North be vacated; <br />WHEREAS, the City conducted a public hearing pursuant to Minnesota Statutes <br />412.851 and received comments from interested parties; and <br />WHEREAS, the Lake Elmo City Council has determined that it is in the public's <br />interest to vacate the following described platted, but unimproved portions of 55 Street <br />North, Lake Elmo, Minnesota. <br />NOW, THEREFORE, BE IT RESOLVED, that the following street segments and <br />utility and drainage easements are hereby vacated as illustrated in Exhibit A and legally <br />described as: <br />Street Segment <br />That portion of 55`x' Street North lying easterly of the northerly extension of the <br />west line of Lot 10 Block 4, Carriage Station Addition, and westerly of the municipal <br />boundary between the City of Lake Elmo, Minnesota and the City of Oak Park Heights, <br />Minnesota. <br />Drainage and Utility Easement <br />The 10 foot wide rear yard drainage and utility easement, excluding the 5 feet adjacent to <br />each side lot line, on Lot 3 through 9, Block 4, Carriage Station Addition; and, the 25 <br />foot wide rear yard drainage and utility easement, excluding the 5 feet adjacent to each <br />side lot line, on Lots 1 and 2, Block 4, Carriage Station Addition. Subject to: <br />1. Conveyance to the City of a drainage and utility easement over the entire vacated <br />portion of the right-of-way prior to recording of this Resolution <br />2. Conveyance to the City of a 20 foot wide trail easement centered over the <br />centerline of 55h Street North opposite Lots 3 through 8, Block 4 Carriage Station <br />Addition, and a 20 foot wide trail easement south of the centerline of 55 Street <br />North opposite Lots 1, 2, and 9, Block 4, Carriage Station Addition prior to <br />recording of this Resolution. <br />3. Conveyance of driveway easements as required to access the properties north of <br />the vacated street from the center line of the vacated street to the north line of the <br />vacated street prior to recording of this resolution. <br />
