CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 2005 -136 <br />A RESOLUTION APPROVING THE FINAL PLAT AND DEVELOPMENT <br />AGREEMENT FOR EAGLE POINT BUSINESS PARK 5th ADDITION <br />WHEREAS, at its September 4, 2001 meeting, the City Council reviewed and <br />approved the Final Plat of Eagle Point Business Park 2nd Addition, creating Outlot A. <br />WHEREAS, Outlot A was further divided with the plat for Eagle Point Business <br />Park 4`h Addition, <br />WHEREAS, at its November 28, 2005 meeting, the Planning Commission <br />recommended approval of the Final Plat, Final PUD Plan and Site Plan to create a 3.7 acre <br />portion of Outlot A, Eagle Point Business Park 2 "d Addition. <br />WEREAS, at its December 6, 2005 meeting, the City Council reviewed the Final <br />Plat of Eagle Point Business Park 5`h Addition and a Final PUD Plan and Site Plan for a <br />30,000 square foot office building on Lot 1, Block 1, Eagle Point Business Park 5`h <br />Addition. <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Lake <br />Elmo does hereby approve and accept the Final Plat and Development Agreement for <br />Eagle Point Business Park 5th Addition, as the same on file with the City Administrator, <br />based on the following conditions. <br />1. Compliance with the recommendations of the City Engineer. <br />2. Compliance with the recommendation of the South Washington Watershed <br />District, as found to be reasonable and practical by the City Engineer. <br />3. Only parking depicted. by the Site Plan located specifically on Lot 1, Block 1, <br />Eagle Point Business Park 51h Addition is hereby approved. <br />4. Submission of complete exterior lighting photometric plan demonstrating <br />compliance with the City exterior lighting standards prior to issuance of a <br />building permit. <br />5. Submission of a Letter of Credit equal to 100% of the site landscape <br />improvements guaranteeing a survival of those improvements for two growing <br />seasons, as prescribed by Section 520 of the City Code. <br />
