CITY OF LAKE ELMO <br />RESOLUTION NO. 2005 -119 <br />A RESOLUTION REQUESTING A HEARING REGARDING THE SEPTEMBER 12, <br />2005 LAKE ELMO SYSTEMS STATEMENT <br />WHEREAS, the City Council has reviewed the September 12, 2005 Systems <br />Statement issued by the metropolitan Council; and, <br />WHEREAS, the City Council finds that certain elements of the Systems <br />Statement are inconsistent with the intent and purpose of the Memorandum of <br />Understanding between the Metropolitan Council and the City, and inconsistent with the <br />Comprehensive Plan prepared by the City responsive to the Memorandum of <br />Understanding, as follow: <br />1. Designation of the residential areas of the City not planned for service by Region <br />Sewer as "Diversified Rural" by the 2030 Development Framework and the <br />Systems Statement. <br />2. The geographic extent and location of "Developing Area" and the designation of <br />"Diversified Rural: on Map W -7 of the Systems Statement. <br />And; <br />WHEREAS, City Staff has advised Metropolitan Council staff of the foregoing, <br />and the Metropolitan Council staff has advised the City by a letter dated October 13, <br />2005 that no modifications to the System Plan will be made in that regard. <br />WHEREAS, the City Council also finds the requirement on Page T -3 of the <br />Systems Statement for the City's Comprehensive Plan. to identify a park- and -ride facility <br />at I -94 and Keats as depicted by the "Park- and -Ride Facility Plan" to be inconsistent with <br />the City's previously stated opposition to a park - and -ride facility at that location. <br />NOW, THEREFORE, BE IT RESOLVED that the Lake Elmo City Council <br />hereby requests a Hearing to resolve the stated disagreements over the content of the <br />Lake Elmo Systems Statement as provided for by State Statute. <br />ADOPTED by the Lake Elmo City Council the I" day of November, 2005. <br />4id�. -�- � � ��.w .r•' 6r� rm <br />Dean Johnston, Mayor r <br />Martin Rafferty �:-- <br />City Administrator <br />
