CITY OF LADE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 2005-078 <br />A RESOLUTION APPROVING THE OPEN SPACE PRESERVATION <br />DEVELOPMENT CONCEPT PLAN BY LAKE EL MO DEVELOPMENT <br />WHEREAS, on the 7h day of June, 2005, the Lake Elmo Development <br />Company, ( "Applicant") submitted a completed application requesting that the City of <br />Lake Elmo approve an Open Space Preservation Development Concept Plan; and <br />WHEREAS, on the 27" day of June, 2005, at a public hearing, the Lake Elmo <br />Planning Commission reviewed the Development Application, the City Planner's reports <br />and comments, the comments of the Applicant and the Applicant's representatives, and <br />recommended approval of the Development Application with conditions. <br />NOW, THEREFORE, DE IT RESOLVED that the Lake Elmo City Council <br />hereby °: <br />Approves the Open Space Concept Plan for the application by Lake Elmo <br />Development Company as illustrated on an MFRA Concept Plan, staff dated June 7, <br />2005 with the following conditions: <br />1. Compliance with recommendations for a neighborhood park as determined by the <br />Lake Elmo Parks Commission, <br />2. Compliance with recommendations of the city engineer, <br />3. Compliance with the city trail system plan, and <br />4. Compliance with VBWD recommendations that the city engineer finds to be <br />practical or applicable. <br />The applicant shall provide written documentation from the Minnesota Land Trust <br />evidencing its review of and comments regarding the location, design and quality <br />of the proposed Preserved Open Space concurrent with the Development Stage <br />application. <br />6. The applicant shall be required to comply with the provisions of Section 400.07, <br />Subd. 6E of the City Code regarding submission with the Preliminary Plat of a <br />"sketch plan" depicting future uses and layout of the 23 acres owned by the <br />applicant but excluded from the OP Plan. Approval by the City of the OP <br />Development Stage Plan and Preliminary Plat shall be, in part, based on City <br />Council satisfaction with the content and design of the sketch plan. <br />
