RESOLUTION NO. 2007-058 <br />RESOLUTION AUTHORIZING PUBLICATION OF <br />ORDINANCE NO. 97-198 BY TITLE AND SUMMARY <br />WHEREAS, the city council of the city of Lake Elmo has adopted Ordinance No. 97 -198, <br />an ordinance to regulate sexually oriented uses within the City of Lake Elmo; and <br />WHEREAS, the ordinance is lengthy; and <br />WHEREAS, Minnesota Statutes, section 412.191, subd. 4, allows publication by title and <br />summary in the case of lengthy ordinances or those containing charts or maps; and <br />WHEREAS, the city council believes that the following summary would clearly inform the <br />public of the intent and effect of the ordinance. <br />NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Lake Elmo, <br />that the city administrator shall cause the following summary of Ordinance No. 97 -198 to be <br />published in the official newspaper in lieu of the entire ordinance: <br />Public Notice <br />The City Council of the city of Lake Elmo has adopted Ordinance No. 97 -198. The ordinance <br />establishes restrictions and controls on sexually oriented uses within the City of Lake Elmo. With <br />the adoption of this ordinance, any such use cannot be located within 1350 feet of any residential <br />district, public or private school with students primarily under the age of 18, or public facilities, or <br />religious place of worship, or within 500 feet of another adult establishment. Provided a proposal <br />meets the location restrictions, such a business would also need to acquire a conditional use permit <br />and the appropriate licenses called for by code.
