CITY OF LAKE ELMO <br />WASHINGTON COUNTY <br />STATE OF MINNESOTA <br />RESOLUTION NO. 2007-055 <br />A RESOLUTION DECLARING A NEGATIVE NEED FOR AN <br />ENVIRONMENTAL IMPACT STATEMENT FOR THE OLD VILLAGE <br />SANITARY SEWER EXTENSION <br />WHEREAS, the City of Lake Eli-no is the Regulatory Government Unit in <br />the preparation of the Environmental Assessment Worksheet (EAW) for the <br />proposed Old Village Sanitary Sewer Extension Project, which will be extending <br />trunk sanitary sewer and water main along 30th Street, from Reid Park to Lake <br />Elmo Avenue, and then south along Lake Elmo Avenue to 20th Street, including <br />a lift station to be installed at 20th Street with a forcemain pipe extending south to <br />a MCES interceptor sewer located at Hudson Boulevard; and <br />WHEREAS, the EAW is based on the construction of a new trunk sanitary <br />sewer and water main; and <br />WHEREAS the EAW analyzed the scenario for construction of the new <br />trunk sanitary sewer with the highest potential environmental impacts ("worst <br />case scenario") among the options that the City is considering-, <br />WHEREAS the City of Lake Elmo has submitted a copy of the EAW to all <br />public agencies on the EAW distribution list, publishing EAW availability in the <br />EQB Monitor on April 23, 2007, all of which were done in accordance with <br />applicable State laws, rules, and regulations; and <br />WHEREAS, the 30-day comment period ended on May 23, 2007, with five <br />regulatory agencies commenting; and <br />WHEREAS, the City of Lake Elmo acknowledges the comments from the <br />Metropolitan Council, the Minnesota Department of Natural Resources, <br />Washington County, the Minnesota Department of Transportation, and the Valley <br />Branch Watershed District; and <br />WHEREAS, the comments received do not Support a need for an <br />Environmental Impact Statement on the proposed project,- and <br />WHEREAS, the City of Lake Elmo has considered the comments that <br />were received and shall complete the Record of Decision supporting the <br />declaration of negative need, including responses to the commenting regulatory <br />agencies. <br />Resolution No. <br />
