CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO, 2007 -046 <br />A RESOLUTION APPROVING VARIANCES TO MINIMUM LOT SIZE, REQUIREMENTS <br />INT 300.09 OF CITY CODE, AND CONSTRUCTION OF AN ON -SITE SEPTIC SYSTEM <br />WITHIN AN AREA OF LESS THAN ONE ACRE AS REQUESTED BY THOMAS <br />DUFRESNE AT 896137 TH STREET NORTH <br />WHEREAS, Thomas DuFresne has made application to the City of Lake Elmo for <br />variances from the minimum Iot size, requirements of 300.09 of City Code, and 1 acre minimum <br />septic system area at 8961 371h Street North, Lake Elmo, Minnesota. <br />WHEREAS, the Lake Elmo Planning Commission considered the variance requests at its <br />.Tune 11, 2007, meeting, and recommended that the variances be granted based on the fallowing <br />Findings: <br />1. The septic location will satisfactorily meet environmental standards. <br />2. The character of the neighborhood will not be impacted by the proposed residential <br />home and septic system as the property was previously utilized with a residential <br />home and septic system. <br />3. The property is larger than many of the platted lots in the neighborhood currently <br />being utilized for residential purposes. <br />4. The applicant was not responsible for the removal of the previously existing home for <br />the property. <br />WHEREAS, the Lake Elmo City Council has reviewed the variances requested by <br />Thomas DuFresne, 8961 37`x' Street North at the June 1.9, 2007 meeting. <br />BE IT FURTHER RESOLVED, that the approval of the requested variance shall include <br />the following conditions: <br />1. The variance shall expire one year from the date of resolution; City Council approval <br />will be required for any subsequent extension. <br />2. Silt fencing shall be shown at the construction limits for the proposed house and <br />driveway with a future building permit application. <br />3. The applicant shall agree to any conditions required by the City Engineer relating to <br />the proposed septic design, area, and construction. <br />4. The applicant shall hook up to the municipal water system. <br />
