CITY OF LAKE ELMO <br />WASHINGTON COUNTY <br />STATE OF MINNESOTA <br />RESOLUTION NO 2009-055 <br />WHEREAS, pursuant to a written contract signed with the City on August <br />18th,. 2009, Gopher State Sealcoat, Inc. has satisfactorily completed the 2009 <br />Crack Sealing Project in accordance with such contract. <br />WHEREAS, the one-year Warranty for the im rovements began • <br />December 15 th , 2009, and will end on December 14tr, 2010 and an one-year <br />warranty inspection will be completed in November, 2010, and the contractor will <br />be required to repair • replace, as directed by the City, any work or materials <br />that are found to be defective, at the Contractor's sole cost and expense. <br />THEREFORE, BE IT RESOLVED, the work completed under said <br />contract is hereby accepted and approved, and, <br />BE IT FURTHER RESOLVED that the City Administrator and Mayor are <br />hereby directed to issue a proper order for the final payment on such contract, <br />taking the contractor's receipt in full. <br />Date: CD 2009 CITY OF LAK E, MO <br />By: <br />Dean A.
