CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION NO. 2010-066 <br />RESOLUTION REGARDING WORKERS' COMPENSATION <br />AND ELIGIBILITY FOR HEALTH CARE COVERAGE FOR ELECTED OFFICIALS <br />WHEREAS, the City of Lake Elmo obtains its Worker's Compensation coverage <br />from the League of Minnesota Cities; <br />WHEREAS, M.S. 176.011, subd. 9, (6) provides "that municipals officers elected <br />or appointed for a regular term of office" are considered to be "employees" for workers <br />compensation purposes only if the city has passed an ordinance or resolution to that <br />effect; <br />WHEREAS, as part of the renewal process, the City must decide whether or not it <br />is the Mayor and Council's intent to be included as employees for workers compensation <br />purposes; <br />WHEREAS, the City Council also has the authority to determine individual <br />Council Member eligibility for inclusion as employees for health care benefits; and <br />WHEREAS, per Minnesota State Stat.§ 415.11, the City Council may not <br />increase total Council Member compensation without adoption of an enabling Ordinance <br />and setting its effective date after the next succeeding local election; and <br />WHEREAS, the City Council's intent is to not raise total Council Member <br />compensation but, rather, to make eligible and allow individual City Council Members to <br />consider the option of selecting to join the City's employee health care program and <br />direct their current compensation towards the total cost of such health care, with any <br />additional costs paid for by the Council Member, resulting in no additional expense to the <br />City. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of the CITY OF <br />LAKE ELMO that the Mayor and Council Members of the CITY OF LAKE ELMO be <br />considered as City employees for the purposes of Workers' Compensation and eligibility <br />for participation in the City's employee health care benefits program. <br />NOW, THEREFORE BE IT FURTHER RESOLVED by the City Council of the <br />CITY OF LAKE ELMO that the Mayor and Council Members of the CITY OF LAKE <br />ELMO be included for coverage in the Minnesota Workers' Compensation Program. <br />RESOLUTION NO. 2010066 <br />
