4) Following the initial appointment of the Library Board, all terms will be for three years, <br />commencing on January I of the year the term begins, with Library Board members <br />allowed to serve no more than three consecutive three-year terms. <br />5) The City Council will appoint an interim library director with the authority to organize <br />and manage the Public Library System until a library director is appointed by the Library <br />Board. The Library Board shall appoint a qualified library director and other staff as <br />necessary, establish the compensation of employees, and remove any of them for cause. <br />6) The City Council will levy an annual, tax upon all taxable property within the City for the <br />support of the library and will place such money in a designated Library Fund. <br />7) Pursuant to Minnesota Statutes § 134.11, the Library Board shall adopt bylaws and <br />regulations for the library, and shall have exclusive control of the expenditure of all <br />money collected for or placed to the credit of the Library Fund, of interest earned on all <br />money collected for or placed to the credit of the Library Fund, of the construction of <br />library buildings, and of the grounds, rooms, and buildings provided for library purposes. <br />8) The City shall set aside certain public property to be further specified by subsequent <br />resolution for the benefit of the Public Library Service. With the approval of the council, <br />the Library Board may erect a library building thereon. <br />9) The City Council may create a citizens' committee, to be comprised of residents from the <br />City of Lake Elmo, to advise the City Council and the Library Board on issues of public <br />concern related to the City of Lake Elmo Public Library Service. <br />Notwithstanding the foregoing, subsequent to date of this Resolution, the City will continue good <br />faith negotiations with Washington County for the purposes of maintaining and improving <br />existing library services or transferring library services from the County to the City and adjusting <br />the special levy limits therefore in accordance with Minnesota Statutes § 275.72. If within sixty <br />(60) days of the date of this Resolution, the City and Washington County resolve to provide <br />library services to the residents of Lake Elmo and the City Council determines that the Public <br />Library established herein is no longer desirable for the City, the City Council may by resolution <br />dissolve the Public Library System and Library Board. Furthermore, the establishment of the <br />Public Library System and the Library Board herein shall be contingent upon the City's <br />determination that there is sufficient funding for the Public Library System. If within sixty (60) <br />days of the date of this Resolution, the City Council determines that there is not sufficient <br />funding for the Public Library System, the City Council may by resolution dissolve the Public <br />Library System and Library Board. <br />
