&I rLy I 1KA) 20 1 _1001 ONCT-11 <br />A RESOLUTION ACCEPTING <br />THE DEVELOPER INSTALLED PUBLIC INFRASTRUCTURE IMPROVEMENTS <br />WA'S <br />Is 11OW's MM M-41131MA01 IM111,111-41JE11111 I, <br />WHEREAS, the public infrastructure improvements the for the Whistling Valley First, <br />Second and Third Additions have been fully completed in compliance with the Standard Form of <br />Completion Agreement Between Surety (Travelers Casualty and Surety Company of America) <br />and Contractor (Colbalt Contracting) dated October 31, 2011, and the standards and ordinances <br />of the City; <br />WHEREAS, the Standard Form of Completion Agreement between Surety and <br />Contractor dated October 31, 2011, supersedes prior representations and agreements including <br />the original development agreement for the improvements, but incorporates Contract Documents, <br />and Plans and Specifications which capture the essential intended public improvement <br />requirements for the development; <br />WHEREAS the City Engineer, Planning Director, and Public Works Superintendent have <br />reviewed the improvements and in correspondence dated November 14, 2012, the City Engineer <br />has issued a Certificate of Completion subject to receipt of the 2-year warranty Bond, and has <br />declared the public infrastructure improvements to be complete and recommends acceptance by <br />the City; <br />WHEREAS, the estimated aggregate costs relating to the installation of public <br />improvements is $1,635,000; and <br />WHEREAS, the City shall, upon acceptance of the improvements, account for those <br />assets. <br />NOW, THEREFORE, BE IT RESOLVED, upon satisfaction of the administrative and <br />financial requirements noted by staff, the City Council accepts the Developer -installed public <br />infrastructure improvements for the Whistling Valley First, Second and Third Additions; <br />effective as of November 20, 2012. <br />Date: 2012 CITY OF LAKE ELMO <br />By - <br />Brett Emmons, Mayor Pro Tern <br />ATTEST: <br />Adam Bell, City Clerk (Skal) <br />Resolution No. 2012-59 <br />
