LAKE ELMO CITY COUNCIL MINUTES October 6, 2009 3 <br />The Council changed the definition to awning to read as follows: A roof-like cover <br />including, but not limited to fabric, metal, or glass designed …” <br /> <br />Council Member DeLapp previously noted he thought it was unfair how some homes are <br />set back further from roadways than others due to varying right-of-way widths in older <br />neighborhoods. <br /> <br />The Planning Commission reconsidered the setback code. The ordinance now reads: <br />Porches as defined in this ordinance may encroach up to 6 feet into a required front yard <br />setback or side corner yard, but in no case shall be setback less than 10 feet from the front <br />property line. A porch is not allowed in a side or rear yard setback. <br /> <br />MOTION: Council Member Smith moved to adopt Ordinance No. 08-017, An ordinance <br />to add definitions for “porch” and “awning” to Section 11.01, and to amend Section <br />154.081 for permitted encroachments on required yards, including the definition change <br />of “awning”. Council Member Emmons seconded the motion.
