<br />Discuss the Minnesota Pollution Control Agency’s (MPCA) proposed alternatives for <br />remediating PFC’s in the Washington County Landfill <br /> <br />Administrator Hoyt introduced the discussion by explaining that the City Council had <br />requested additional time for discussing the proposed options for the PFC cleanup of the <br />Washington County Landfill by the PCA. <br /> <br />The Mayor and Council members asked the PCA several questions related to the <br />preferred option, the dig and line option. The City Council requested that the PCA <br />consider a permanent solution to the wastes such as the dig and truck option to another, <br />more appropriate site with the future option of burning it in a plasma burner. <br /> <br />Representatives of PCA answered questions and explained that there would be a public <br />meeting and a public comment period for the City Council to formally provide <br />comments. <br /> <br />Jim Blackford, 9765 45th Street N., provided information on the cost comparisons using a <br />plasma torch for a regional disposal approach. He reiterated his concern about keeping <br />the landfill in Lake Elmo and his preference on providing a long term solution for the <br />waste. <br /> <br />State Representative Julie Bunn submitted an email letter to the council with her <br />comments on the remediation options for the Washington County Landfill. <br /> <br />Mayor Johnston said that the City Council will review this item when it is time for the <br />city to submit comments in the public comment period. <br /> <br />Consider an ordinance to amend general front yard setback regulations in all zoning <br />districts to include developed lots <br /> <br />Consulting planner Ben Gozola presented a report on amending section 154.082 of the <br />code to allow front yard setback flexibility in all zoning districts on developed as well as <br />undeveloped lots. The proposed ordinance responds to resident concerns (primarily in <br />older areas of the City) that variances should not be required for nonconformities if the <br />construction is consistent with adjacent structures. The planning commission initiated the <br />request to amend the ordinance and recommended its approval. <br /> <br />MOTION: Council Member DeLapp moved to approve Resolution no. 2008-007 for <br />publication of Ordinance no. 08-03 summary and ordinance no. 08-03 to broaden the <br />flexibility for front yard setbacks in all zoning districts to include developed lots through <br />the following language: <br /> <br />Where adjacent residential structures on the same side of the street between intersections <br />have front yard setbacks different from those required, the front yard minimum setback <br />shall be the average of the immediately adjacent structures.
