RESOLUTION 2016-64 <br /> <br />RESOLUTION OF THE CITY OF LAKE ELMO, <br />WASHINGTON COUNTY, MINNESOTA, CENSURING OF <br /> COUNCILMEMBER JUSTIN BLOYER <br /> <br /> <br />WHEREAS recent behavior by Councilmember Justin Bloyer has created great concern by the <br />other Councilmembers regarding his leadership, handling of private confidential information, and ability <br />to interact with City staff; and <br />WHEREAS, these concerns include the following: <br />1. Repeated unauthorized release of protected, confidential information to the press/others which <br />puts the city at great risk. <br />2. Public hostility towards city staff members at city council meetings along with disparaging <br />remarks about their work product that are known to be false. <br />3. Publicly announcing at a council meeting that he has taped every conversation he has had with <br />city staff, which has created an unhealthy, unfriendly, uncomfortable, and intolerable <br />environment for our city staff. <br />WHEREAS, the City Council believes it has an affirmative duty to maintain security surrounding <br />its private, confidential records and to provide a healthy, safe workplace free of the kind of behaviors <br />Councilmember Bloyer has exhibited. <br />WHEREAS, the City Council has determined that Councilmember Bloyer’s conduct is <br />unbecoming of the office of Councilmember of the City of Lake Elmo. <br />NOW, THEREFORE, be it resolved that by the City Council of the City of Lake Elmo, <br />Washington County, Minnesota as follows: <br />1. A formal censure of Councilmember Bloyer is hereby issued by the City Council for <br />inappropriate conduct. <br />2. The City Council is also recommending that: <br />a. Councilmember Bloyer participate in training on the handling of confidential <br />information including the importance of not releasing private, confidential information, <br />not taping of Executive Sessions, and not sharing information that was discussed in <br />closed executive sessions of the city council. <br />b. Councilmember Bloyer not interact with any member of the city staff without another <br />councilmember present, that Councilmember Bloyer direct all questions during city <br />council meetings to the Chair, and that Councilmember Bloyer not call city staff <br />members, but instead use email to communicate with city staff members. <br />It is our understanding that these recommendations are not legally enforceable and would <br />be voluntary on the part of Councilmember Bloyer.
