Current Article XVH, renumbered to Article XIX by this ordinance, is hereby restated and <br />incorporated herein unchanged except for its hierarchy of sections references which shall be amended <br />to follow the following subsection hierarchy: <br />Section Number. Subsection <br />i. Subsection <br />ii. Subsection <br />iii. Subsection <br />• Current Section 154.800(c)(0), changed to 154.800(L) as part of the subsection hierarchy update <br />above, is amended as follows: "Residential planned unit developments shall be permitted in <br />shoreland areas subject to the requirements of Article XVIH of this chapter." All subsections of <br />154.800(L) are restated and incorporated herein unchanged. <br />SECTION 4. The City Council of the City of Lake Elmo hereby amends Title XV: Land <br />Usage; Chapter 154: Zoning Code, to add Article XVI: OPEN SPACE PLANNED UNIT <br />DEVELOPMENTS <br />ArticleXVL OPEN SPA CEPLANNED UNIT DEVELOPMENTS <br />§ 154.650 PURPOSE. <br />The purpose of open space planned unit developments is to provide greater development flexibility within <br />rural portions of the community while maintaining the rural character by preserving agricultural land, <br />woodlands, wildlife or natural corridors, pollinator & wildlife habitat, and other significant natural features <br />consistent with the goals and objectives of the city's Comprehensive Plan. The City reserves the right to <br />deny establishment of an open space PUD overlay district and direct a developer to re -apply under standard <br />zoning provisions if it is determined that proposed benefits of the open space PUD do not justify the <br />requested flexibilities. <br />Page 4 of 26 <br />
