Ordinance 0E-023 City Council: 1126110 <br />SECTION 2. The City Council of the City of Lake Elmo hereby amends Title I: General <br />Provisions; Chapter 11: General Code Provisions, by amending section 11.01 Definitions to <br />eliminate existing definitions as follows: <br />RECREATION VEHICLE. Any vehicle or structure designed and used for temporary, <br />seasonal human living quarters which meet all of the following qualifications: <br />(1) Is not used as the permanent residence of the owner or occupant; <br />(2) Is used for temporary living quarters by the owner or occupant while engaged in <br />recreational or vacation activities; <br />(3) Is towed or self-propelled on public streets or highways incidental to the <br />recreational or vacation activities; and <br />(4) Examples of vehicles include van campers, tent camping trailers, self-contained <br />travel trailers, pickup campers, camping buses, and self-contained self-propelled truck chassis <br />mounted vehicles providing living accommodations. <br />SECTION 3. The City Council of the City of Lake Elmo hereby amends Title 1: General <br />Provisions; Chapter 11: General Code Provisions, by amending section 11.01 Definitions to <br />add the following definitions in alphabetical order with the already existing definitions: <br />LOWEST FLOOR. The lowest floor of the lowest enclosed area (including basement). An <br />unfinished or flood resistant enclosure, used solely for parking of vehicles, building access, or <br />storage in an area other than a basement area, is not considered a building's lowest floor. <br />RECREATIONAL VEHICLE. A vehicle that is built on a single chassis, is 400 square <br />feet or less when measured at the largest horizontal projection, is designed to be self-propelled or <br />permanently towable by a light duty truck, and is designed primarily not for use as a permanent <br />dwelling but as temporary living quarters for recreational, camping, travel, or seasonal use. For <br />the purposes of this Ordinance, the term recreational vehicle shall be synonymous with the term <br />travel trailer/travel vehicle. <br />SUBSTANTIAL DAMAGE. Damage of any origin sustained by a structure where the cost <br />of restoring the structure to its before damaged condition would equal or exceed 50 percent of <br />the market value of the structure before the damage occurred. <br />SUBSTANTIAL IMPROVEMENT. Within any consecutive 365-day period, any <br />reconstruction, rehabilitation (including normal maintenance and repair), repair after damage, <br />addition, or other improvement of a structure, the cost of which equals or exceeds 50 percent of <br />the market value of the structure before the "start of construction" of the improvement. This <br />term includes structures that have incurred "substantial damage," regardless of the actual repair <br />work performed. The term does not, however, include either: <br />(1) Any project for improvement of a structure to correct existing violations of state or <br />local health, sanitary, or safety code specifications which have been identified by the local code <br />enforcement official and which are the minimum necessary to assure safe living conditions. <br />
