STATE OF MINNESOTA <br />COUNTY OF WASHINGTON <br />CITY OF LAKE ELMO <br />ORDINANCE NO.08-020 <br />AN ORDINANCE REPEALING ORDINANCE NO.08-012 ESTABLISHING A <br />MORATORIUM RELATING TO THE CONSTRUCTION OR MODIFICATION OF A <br />NEW OR EXISTING TELECOMMUNICATION TOWERS <br />BACKGROUND <br />On January 6, 2009, the City adopted a moratorium to allow evaluation of the City's <br />regulations relating to telecommunication towers and to conduct studies regarding same. At this <br />time, the City believes that it has concluded that study and it has adopted a new <br />telecommunication tower ordinance and therefore the City desires to terminate the moratorium <br />established by Ordinance No. 08-012. <br />NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Lake Elmo, <br />Washington County, Minnesota, as follows: <br />1. Ordinance No. 08-012, establishing a moratorium relating to the construction or <br />modification of new or existing telecommunication towers is repealed effective December 1, <br />2009. <br />2. Severability. If any provision of this ordinance or its application to any person is <br />held invalid, the remainder of this ordinance and the application to other persons or firms shall <br />not be affected. Remaining sections of the ordinance shall be interpreted to give effect to the <br />spirit of the ordinance prior to removal of the portions declared invalid. <br />3. Effective Date.
