ORDINANCE NO. 97-48 <br />AN ORDINANCE EXTENDING THE DEVELOPMENT MORATORIUM ON <br />PROPERTY LOCATED WITHIN THE PUBLIC FACILITY (PF) ZONING <br />DISTRICT OF THE CITY. <br />THE LAKE ELMO CITY COUNCIL ORDAINS: <br />1.0 Recitals. <br />A. On the 7th day of April, 1998, the Lake Elmo City Council <br />adopted Ordinance No. 97-28 which established a <br />development moratorium for property located within the <br />City's PF Zoning District. The Development Moratorium <br />was to expire on the 17th day of April, 1999. <br />B. On the 6th day of April, 1999, the Lake Elmo City Council <br />adopted Ordinance No. 97-42 which extended the original <br />Moratorium from April 17, 1999 to July 20, 1999. <br />C. The Lake Elmo City Council, City Staff and some of the <br />affected property owners have continued to discuss the <br />text and impact of the proposed PF Regulations. <br />D. The Lake Elmo City Council has determined that it will <br />need to again extend the Development Moratorium in order <br />to draft revisions to proposed regulations resulting from <br />discussions with affected property owners and to permit <br />the City's Planning Commission to review the proposed <br />revisions prior to final action by the City Council. <br />2.0 Development Moratorium. The Lake Elmo City Council <br />hereby adopts a development moratorium applicable to all property <br />located within the City's Public Facility (PF) Zoning District. <br />3.0 Duration of Moratorium. The development moratorium will <br />commence on the effective date of this ordinance and will continue <br />until the 21st day of December, 1999 unless otherwise terminated or <br />extended by action of the City Council. <br />4.0 Enforcement. The City of Lake Elmo may enforce any <br />provision of this ordinance by mandamus, injunction, or any other <br />appropriate civil remedy in any court of competent jurisdiction. <br />5.0 Separability. Every section, provision, or part of this <br />ordinance is declared separable from every other section, provision <br />or part of this ordinance. If any section, provision, or part of <br />this ordinance is adjudged to be invalid by a court of competent <br />jurisdiction, such judgment shall not invalidate any other section, <br />provision or part of this ordinance. <br />
