the viewing habits of Subscribers shall be sold or otherwise made available <br />to any party other than to Grantee or its agents for Grantee's service business <br />use or to City for the purpose of Franchise administration, and also to the <br />Subscriber subject of that information, unless Grantee has received specific <br />written authorization from the Subscriber to make such data available. Such <br />written permission shall be for a limited period of time not to exceed one (1) <br />year which may be renewed at the option of the Subscriber. No penalty shall <br />be invoked for a Subscriber's failure to provide or renew such authorization. <br />The authorization shall be revocable at any time by the Subscriber without <br />penalty of any kind whatsoever. <br />C. Written permission from the Subscriber shall not be required for the <br />conducting of System wide or individually addressed electronic sweeps for <br />the purpose of verifying System integrity or monitoring for the purpose of <br />billing. Confidentiality of such information shall be subject to the provision <br />set forth in subparagraph (b) of this Section. <br />SECTION 12. <br />UNAUTHORIZED CONNECTIONS AND MODIFICATIONS <br />1. Unauthorized Connections or Modifications Prohibited. It shall be unlawful for <br />any firm, Person, group, company, corporation, or governmental body or agency, <br />without the express consent of the Grantee, to make or possess, or assist anybody in <br />making or possessing, any unauthorized connection, extension, or division, whether <br />physically, acoustically, inductively, electronically or otherwise, with or to any <br />segment of the System or receive services of the System without Grantee's <br />authorization. <br />2. Removal or Destruction Prohibited. It shall be unlawful for any firm, Person, <br />group, company, or corporation to willfully interfere, tamper, remove, obstruct, or <br />damage, or assist thereof, any part or segment of the System for any purpose <br />whatsoever, except for any rights City may have pursuant to this Franchise or its <br />police powers. <br />3. Penally. Any firm, Person, group, company, or corporation found guilty of violating <br />this section may be fined not less than Twenty Dollars ($20.00) and the costs of the <br />action nor more than Five Hundred Dollars ($500.00) and the costs of the action for <br />each and every subsequent offense. Each continuing day of the violation shall be <br />considered a separate occurrence. <br />36 <br />
