ORDINANCE NO. 97-52 <br />AN ORDINANCE EXTENDING THE DEVELOPMENT MORATORIUM ON <br />PROPERTY LOCATED WITHIN THE PUBLIC FACILITY (PF) ZONING <br />DISTRICT OF THE CITY. <br />THE LAKE ELMO CITY COUNCIL ORDAINS: <br />1.0 Recitals. <br />A. On the 7th day of April, 1998, the Lake Elmo City Council adopted Ordinance <br />No. 97-28 which established a development moratorium for property located <br />within the City's PF Zoning District. The Development Moratorium was to expire <br />on the 17th day of April, 1999. <br />B. On the 6th day of April, 1999, the Lake Elmo City Council adopted Ordinance <br />No. 97-42 which extended the original Moratorium from April 17, 1999 toJuly <br />20, 1999. <br />C. On 6th day of July, 1999, the Lake Elmo City Council adopted Ordinance No. <br />97-48 which extended the original Moratorium from July 20, 1999 to December <br />21, 1999. <br />D. The Lake Elmo City Council, City Staff and some of the affected property owners <br />have continued to discuss the text and impact of the proposed PF Regulations. <br />E. The Lake Elmo City Council has determined that it will need to again extend the <br />Development Moratorium in order to draft revisions to proposed regulations <br />resultingfrom discussions with affected property owners and to permit the City's <br />Planning Commission to review the proposed revisions priorto final action by the <br />City Council. <br />2.0 Development Moratorium. The Lake Elmo City Council hereby adopts a <br />development moratorium applicable to all property located within the City's Public Facility (PF) <br />Zoning District. <br />3.0 Duration of Moratorium. The development moratorium will commence on the <br />effective date of this ordinance and will continue until the 11th day of April, 2000 unless <br />otherwise terminated or extended by action of the City Council. <br />4.0 Enforcement. The City of Lake Elmo may enforce any provision of this ordinance <br />by mandamus, injunction, or any other appropriate civil remedy in any court of competent <br />jurisdiction. <br />
