CITY OF LAKE ELMO <br />WASMNGTON COUNTY, MINNESOTA <br />ORDINANCE 9704 <br />AN ORDINANCE AMENDING SECTION 400.09 SUBDIVTSION 2 AND DELETING <br />SECTION 400.09 STIBD"ION 3 OF THE LAKE ELMO MUNICIPAL CODE <br />. RELATING TO FINAL PLATS <br />Section 1. Amendment: Section 400.09 Subdivision 2. Approval of the City Council of the 1997 Lake <br />Elmo Municipal Code is hereby amended to read as follows: <br />Twenty (20) copies of the final plat shall be submitted to the Administrator at least ten (10) days prior to <br />the City Council meeting at which consideration is requested. After review of the final plat by the staff <br />the final plat shall be approved or disapproved within sixty (60) days after the filing of the final plat by <br />resolution and conditioned upon the execution of the development agreement for basic improvements, <br />public dedication, bonding and other requirements determined necessary or appropriate by the Council. If <br />disapproved, the grounds for any refusal to approve a plat shall be set forth in the proceedings of the <br />Council and reported to the applicant. <br />The resolution approving airy such plat shall authorize the Mayor and Administrator to execute an <br />endorsement of approval for the City. The Mayor and Administrator shall not execute the endorsement <br />until any development agreement or bonds required by the resolution of the approval have been approved <br />in writing by the City Attorney. <br />Section 2. EFFECTIVE DATE: This ordinance shall be effective upon its passage and publication <br />according to law. <br />ADOPTION DATE: Passed by the City Council of the City of Lake Elmo the 6th day of May, 1997. <br />MEX3 <br />i <br />ATTEST: <br />
