CITY OF LAKE ELMO <br />WASBINGTON COUNTY, MINNESOTA <br />ORDINANCE 97- 0 7 <br />AN ORDINANCE AMENDING SECTION 400.03 SUBD 4 `BUILDING PERMITS" <br />AND ADDING SECTION 400.03 SUBD 4 A. 1 and 2, and B. <br />TO THE LAKE ELMO MUNICIPAL CODE <br />Section 1. Amendment: Section 400.03 Subd. 4 `Building Permits" of the Lake Elmo <br />Municipal Code is hereby amended as follows; to wit: <br />Subd 4. Buildine Permits <br />No building permits shall be issued for the construction of any building, structure or <br />improvement to any land or lot in a subdivision, as defined in this section, until all <br />requirements of this section have been satisfied, with the following exception: <br />A. Building Permits may be issued for Model Homes after approval of the final <br />plat by the Council provided the following conditions are satisfied: <br />1. A signed Developers Agreement which shall include securitv for <br />improvements as set forth in Section 400.16 Subd 9 A and B. <br />2. Developer shall agree in writing to indemnify and hold harmless the City for <br />damages that may occur as a result of the model home construction prior to <br />the required improvements being completed. <br />B. No Certificate of Occupancy shall be issued by the City until the first wear <br />course on a public street is completed and approved by the City Engineer. <br />Section 2.
