Section 720 - Alternative Waste Disposal Systems - Wetland Treatment Systems <br />720.01 Title. <br />This Section shall be known, cited and referred to as the Alternative Waste Disposal System <br />ordinance. <br />720.02 Intent and Purpose. <br />Subd. 1 Health. Safety, and Welfare. <br />The purpose of this section is to protect the health, safety, and welfare of the residents of the <br />community, present and future. <br />Subd. 2 Contamination of Surface/Ground Water. <br />The purpose of this section is to regulate the location, design, installation, use, and <br />maintenance of alternative waste disposal systems so as to prevent the contamination of the <br />surface and ground water within the community. <br />Subd. 3 Contamination of Private Water Supply Wells. <br />The intent of this section is to protect the individual water supply wells of the community from <br />contamination by inadequate, improperly designed, located, installed or maintained individual <br />and community sewage treatment systems. <br />Subd. 4 Open Space Development. <br />The intent of this section is to allow subsurface flow - "wetland treatment" systems to be an <br />allowed alternative system within cluster developments. <br />720.03 Rules. <br />Subd. 1 Specifications Which Apply. <br />Lake Elmo Municipal Code Section 700 shall apply. <br />Subd. 2 Location of Systems. <br />A. Setbacks. All components of a wetland treatment system within a new residential or <br />commercial development, with a design flow of 1500 gallons per day or more, including <br />stilling tanks, pump stations, and treatment cells shall be located a minimum of 100 feet <br />from any property line, and 200 feet from any existing or proposed home. Stilling tanks <br />may however be located 50 feet from a street right-of-way. <br />Wetland treatment systems used to replace failed septic systems, and those with less than <br />a 1500-gallon per day design flow shall have setbacks considered reasonable for the site <br />and the neighboring properties. <br />
