COMMUNITY PROGRAMMING, COMMUNITY PROGRAMMING <br />CHANNELS AND INSTITUTIONAL NETWORK REQUIREMENTS. <br />11.01 Minimum Required Community Programming Channels. Company shall <br />provide to each of its Subscribers who receives some or all of the total services offered on <br />System reception, without charge, Community Programming on the Community <br />Programming Channels, pursuantto thejoint responsibilities between Grantorand Company <br />described in the Franchise Agreement. The Grantor shall provide through the Community <br />Programming Channels at least one specially designated noncommercial public access <br />channel available for use by the general public on a first -come, first -served, <br />nondiscriminatory basis; at least one specially designated access channel for use by local <br />educational authorities; at least one specially designated access channel available for local <br />government use; and at least one specially designated access channel available for lease on <br />a first -come, first -served, nondiscriminatory basis by commercial and noncommercial users. <br />The VHF spectrum shall be used for at least one of the specially designated noncommercial <br />public access channels required in this paragraph unless specifically waived by Grantor or <br />its designee. No charges may be made by Grantor for channel time or playback of <br />prerecorded programming on at least one of the specially designated noncommercial public <br />access channels required by this subdivision, provided, however, that personnel, equipment, <br />and production costs may be assessed for live studio presentations exceeding five minutes <br />in length.
