STATE OF MINNESOTA <br />COUNTY OF WASHINGTON <br />CITY OF LAKE ELMO <br />ORDINANCE NO. 8107 <br />AN ORDINANCE RELATING TO PUBLIC USE DEDICATION REQUIREMENTS. <br />The Lake Elmo City Council ordains that Section 401.400 C.3 <br />and its subdivisions are hereby added to the Lake Elmo Municipal <br />Code to read as follows: <br />401.400 C.3. Land within a protected wetland or within a <br />floodplain area unless the City Council determines that all of the <br />following criteria are satisfied: <br />a. would be in the best interests of the general public; <br />b. would be a valuable resource for environmental <br />preservation, educational or habitat preservation <br />purposes; <br />C. has an exceptional aesthetic value; and <br />d. would not become financially burdensome to the City as a <br />result of maintenance or preservation requirements. <br />Effective Date. This ordinance shall be effective the day <br />following its publication. <br />Adoption Date.
