STATE OF MINNESOTA <br />COUNTY OF WASHINGTON <br />CITY OF LAKE ELMO <br />ORDINANCE 8074 <br />AN ORDINANCE AMENDING SECTION 301.060D 1 <br />(CONDITIONAL USE PERMITS) OF THE LAKE ELMO MUNICIPAL CODE <br />The City Council ordains that Section 301.060D1 of the Lake <br />Elmo Municipal Code shall be amended to read as follows: <br />Section 301.060D1 Conditional Use Permits <br />Conditional Use Permits may be granted or denied in any <br />district by action of the governing body according to the <br />standards for that district. In granting a conditional use <br />permit the governing body shall consider the advice and <br />recommendations of the Planning Commission and the effect of <br />the proposed use upon the health, safety, morals, <br />convenience, and general welfare of occupants of surrounding <br />lands, existing and anticipated traffic conditions including <br />parking facilities on adjacent streets and land, the effect <br />on utility and school capacities, the effect on property <br />values of property in the surrounding area, and the effect <br />of the proposed use on the Comprehensive Plan. If it shall <br />determine that the proposed use will not be detrimental to <br />the health, safety, convenience, morals, or general welfare <br />of the community nor will cause serious traffic congestion <br />nor hazards, nor will seriously depreciate surrounding <br />property values, and that said use is in harmony with the <br />general purpose and intent of this Ordinance and the <br />Comprehensive Plan, the council may grant such permits. <br />EFFECTIVE DATE: This ordinance shall become effective the <br />day following its publication. <br />ADOPTED by the Lake Elmo City Council on the th day of <br />October, 1992. <br />David Johnso ayor <br />ATTEST: AV: ZC �/ � YTUI(- <br />Mary Ktteffne,City Administrator <br />Published in the St. Croix Valley Press the 4th day of <br />November, 1992. <br />
