Minutes of the Lake Elmo Village Council September 15, 1970 <br />Meeting called to order by Mayor Brockman at & 7:45PM. <br />Present:BrookmangWatson,Abercrombie,Shervhe m,Friedrich,Park & Mehsikoiner, <br />Maynard Eder & Bruce Folz speaking in behalf of the trailway system thru <br />parts of the Village of Lake Talmo asked that the Council reconsider the <br />decision given as being opposed to such a system. Motion by Councilman <br />Watson 2nd by Councilman Shervheim that the Council let their decision <br />stand and instruct the Planning Commission to study the pros and cons in <br />more detail and report back to the Council with their findings. Carried 5/0. <br />Dick Lambert asked to be heard relative to the dog ordinance recently <br />enacted by the: Council. It was his opinion that the ordinance adversely <br />affected the: dog breeder who, under the ordinance, would be considered a~ <br />kennel operator. It also opened up the distribution of animals to what <br />Dick chose to call puppy mill breeders which produce an inferior type <br />of animal. Dick said he did not know the answer but volunteered to pursue <br />the matter and report back to; the Coucnil of his findings. Council accepted. <br />Dexter Ziton appeared befog the Council regarding issuance of a building <br />permit on property which he formerly owned and on which he had received as <br />permit to build. Mr. Ziton sold the property to a Mr. Gordan Lane who was <br />refused a permit to build.. Mr. Ziton said that he sold the property in <br />good faith thinking that if he would be issued a permit that another owner <br />would. receive the same consideration. Refusal was given to Mr. Lane to <br />the grounds that the property did not: adhere to the minimum lot size as <br />covered by Village Ordinance. Legal Counsel Raleigh advised the Council <br />that: he had researched this matter and determined that the property had <br />been divided before the ordinance was passed. Motion by Councilman <br />Abercrombie 2nd by Councilman Watson that based on a decision of Village <br />Counsel that the properrty in question was subdivided before the passage <br />of the sub division ordinance that provisional approval of the Gordon <br />Lane building permit be given. Provisional in that it has to meet the <br />requirements of the building code and have a sewage system above the <br />930 ft. elevation.. Carried 5-»0. <br />At; the request of Ralph Oace & Mrs. Oace a hearing was set up for Oct.6,. <br />1970 at 7:30PM at the Village Council Chambers to consider vacating a <br />piece of roadway described as follows: All of the 33 foot street lying <br />Easterly of and adjoining; the South 470 feet, of Lot 7, Three Lakes Farm <br />Addition and its extension Southerly to the Northweserly line of Lake Jane <br />Road extended Northeasterly: and, All. of Twk the 33 foot street lying <br />Southerly of and adjoining Lot 7,Three Lakes Farm Addition. <br />Peter Van DuSartz offered some preliminary plans for the development of <br />]sake Jane Hills. The Council asked the engineer to check into this and <br />have some information for them at a special meeting of the Council on <br />Monday September 28, 1970 at the Village Clerk's Office.. Mr. Van DuSartz <br />was. advised that he would be placed an the agenda of the Village Council <br />for October t:& 209, 1970 at, 8:50PM. <br />Building Inspector advised that xxxk Irvin Friedrich had requested per -- <br />mission to move a house from.Woodbury to Friedrich Heights in -the Village. <br />Ben Friedrich .had inspected the: house and advised the Council that it was <br />a good building and was within the building code of the 'pillage. Permission <br />for the move was given based an Bens: recommendation.. <br />Rich Peterson was on hand to discuss the postion of Forester and wham he <br />was expected to do. He was: advised to check several representative areas <br />and give the council a general report based on this sampling. The Council <br />asked for an educational program to inform the citizens of their position. <br />and what they the individual could do -to correct it. Clerk advised to <br />notify -the press that anyone in the Village that would like to discuss <br />this matter as; it pertains to them with the Forester could leave their <br />name at the Village office and they would be contacted. <br />
