R-71--10 RESOLUTION VILLAGE OF LAKE ELMO WASHINGTON COUNTY,.. MINNESOTA A RESOLUTION APPROVING AND URGING PASSAGE OF A BILL FOR AN ACT GRANTING THE DISTRICT COURT JURISDICTION TO ADJUST THE BOUNDARY BETWEEN THE -VILLAGES OF LAKE ELMO AND OAK - DALE : .1 WHEREAS, the present boundary line between the Village of Lake Elmo and the Village of Oakdale divides certain pro- perties and residences located in Sections 5 and S of Township 29 North, Range 21 West; and WHEREAS, the division of said properties between muni- cipalities appears to constitute a serious inconvenience to the owners thereof and, in all probability, diminishes the value of their property; and, WHEREAS, there appears,to be some doubt as to whether the governing bodies of the said villages will be able to con- cur in and effectuate an appropriate adjustment of their mutu- al boundary in said sections.,..and WHEREAS, the Village Council of the Village of Lake boundary line eliminated and at the same time have the boun- dary line permanently fixed sometime within the not too dis- tant future: BE IT, THEREFORE, RESOLVED by the Village Council of the Village of Lake Elmo that said Council recommend and urge the passage of a Bill granting the District Court jurisdiction to adjust the boundary within said Sections 5 and 8 of Township 29 North, Range 21 West, and that the Bill designated as House File No. 3129 during the 1971 Legislative Session be passed in substantially its present form provided however that said Bill shall include provisions requiring all property owners within said sections be given notice of any District Court pro- ceedings and have an opportunity to be heard therein, and, also, placing a reasonable limit on the time during which a petition for adjustment of said boundary may be filed with the District Court.
