R-71-10 - j <br />RESOLUTION <br />VILLAGE OF LAKE ELMO <br />WASHINGTON COUNTY, 1' INNESOTA <br />A RESOLUTION GRANTING REQUESTED VARIANCE <br />FROM ZONING CODE PROVISIONS. <br />WHEREAS, Bernard Witzmann of 3710 Lane Boulevard is <br />owner of a residential lot in the Village of Lake Elmo (con- <br />sisting of Lots 758, 759, 760, 889, 890, and 891 of L.ANE's <br />DEMONTREVILLE COUNTRY CLUB ADDITION) which lot does not meet <br />the size requirements under the provisions of the Village <br />Zoning Codes; <br />IWHEREAS, said Bernard Witzmann has asked for a vari- <br />ance from the provisions of the said Zoning Code to permit re- <br />modeling of the non --conforming structure on said loth <br />WHEREAS, (I) of Section 34.03 of the Model Zoning <br />Code as adopted in the Village of Lake Elmo provides that al- <br />terations may be made to a structure or building containing <br />lawful non -conforming residential units when they will im- <br />prove the livability thereof, provided they will not increase <br />the number of dwelling units; and <br />'WHEREAS, the remodeling for which this variance is <br />requested (see Exhibit "A") does not increase the capacity of <br />the present residential unit and yet would improve its liva- <br />bility and this council has, accordingly, determined that <br />the granting of a variance in this case would therefore be <br />within the policy set forth by the Zoning Ordinance: <br />NOW THEREFORE, BE IT RESOLVED that a variance be <br />granted said Bernard Witzmann to permit him to obtain a buil- <br />ding code to undertake the remodeling and alteration to the <br />structure on the above referred to premises; provided, how- <br />ever, said remodeling is made solely in accordance with the <br />plan annexed hereto as Exhibit "A". <br />Adopted by the Village Council June 15, 1971. <br />0"I., V'7 <br />Calyx J. rookman, Mayor <br />Attest: <br />Do ald Meh ik mer, C erk <br />
