R -71-18 <br />RESOLUTION <br />VILIAGE OF LAKE EIS D <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION RECEIVING ENGINEER'S PRELIMINARY REPORT AND <br />CALLING FOR A HEARING ON THE IMPROVEMENT OF THE DAWCIN <br />ACRES ROAD AND ORDERING PREPARATION OF PLANS THEREFOR <br />WHEREAS: <br />A. The Village Council deems it necessary and expedient that the <br />Village of Lake Elmo, Minnesota, construct a hard surface road on the land platted <br />as DAWCIN ACRES as that road is deAcribed in and in accordance with the preliminary <br />plans and reports prepared by Bonestroo, Rosene, Anderuk & Associates, Inc., <br />consulting engineers; the Council also deems it necessary and expedient that <br />said work be done, if possible, before winter* <br />B. The Council has been advised by said consulting engineers that <br />the said road improvements are feasible, should be made as proposed and can be <br />completed before winter if the preparation of plans and advertising for bids <br />is undertaken without further delay; the consulting engineers' report with respect <br />to these matters has heretofore been received by the Council and filed with the <br />Village Clerk; <br />C. The Statute provides that no such improvements shall be made until <br />the Council has held a public hearing on such improvements following mailed notice <br />and two publications thereof in the official newspaper stating time—and—placethe— o the hearing, the general nature of the improvement, the estimated cost thereof, <br />and the area proposed to be assessed in accordance with law; <br />NOW THEREFORE, BE IT RESOLVED by the Village Council of the Village <br />of Lake Elmo, Minnesota, as follows: <br />1. A public hearing will be held at the time and place set forth in <br />the Notice of Hearing hereto attached to consider said proposed improvements. <br />2. The nature of the improvements, the estimated cost of each major <br />portion thereof, and the area proposed to be assessed therefor are described in <br />the form of Notice of Hearing hereto attached. <br />3. The notice of said public hearing shall be in substantially the <br />form contained in the notice hereto attached. <br />4. The Village Clerk is hereby authorized and directed to cause notice <br />of said hearing to be given as required by law. <br />in <br />S. Council finds that it is/the best interests of the Village of Lake <br />Elmo that said road improvements be completed before winter and that, in order to <br />do so, it is necessary that said consulting engineers proceed immediately with <br />the preparation of plans therefor and that advertisements for bids be published <br />according to law as soon as is possible; the Village Council has further determined <br />that the cost of said plans will not be great because of the nature of the <br />
