It feels that the Village Clerk should not become involved <br />in conveying applications for construction permits between <br />the applicant and the Managers of the Watershed District and <br />that the proper procedure would be for the individuals seeking <br />construction permits to get separate permits from the Village <br />and the Watershed District. The Village could cooperate and <br />assist the Watershed District by requiring a building permit <br />from the Watershed District as a pre -requisite to the issuance <br />of a building permit by the Village where the building site <br />is located within the flood plain (provided, of course, that <br />the Watershed District provides the Village with an adequate <br />map designating the limits of the flood plain). <br />In summary, it is the Council's concern that the Village <br />avoid being placed in a position where it serves as intermediary <br />between an applicant and the Managers of the Watershed District, <br />at best it will create extra work for the Village staff and, more <br />likely than not, it will place the Village Council in a position <br />of having to defend any action taken by, or any failure to act <br />on the part of the Watershed District. <br />3. Section V, Subd. 1 requires a permit be obtained <br />from the Watershed District for any ditching, grading, filling, <br />etc. which would result in removal of top soil or vegetation <br />from one acre or more, or which would "increase, concentrate, or <br />dispose of runoff ... which might cause or increase erosion". It <br />seems that this requirement would apply to any land within the <br />Village, and such being the case, the language seems a little <br />broad. <br />4. Section VI, Subds. 1 and 2 require the Village <br />to submit copies of proposed ordinances relating to flood plain <br />zoning, surface waters drainage and shore use be submitted to <br />the Watershed District before publication; this is a reasonable <br />expectation on the part of the Watershed District and the Council <br />wants to follow such a procedure whether or not it is in the <br />regulation. <br />Dated: March 8, 1972. <br />BY ORDER OF THE COUNCIL <br />DONALD MEHSIKOMER <br />Village Clerk <br />
