R-72-11 <br />RESOLUTION <br />VILLAGE OF LAKE EII40 <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION VACATING PART OF A STREET IN THE PLAT OF <br />BERSCHEN'S SHORES <br />WHEREAS, a petition dated May 17, 1971 has been pre- <br />sented to the Village Council of the Village of Lake Elmo by 17 <br />property owners praying for the vacation of a certain part of a <br />public street in the Village of Lake Elmo which public street is <br />more particularly described below; and <br />WHEREAS, said petition came before the Village Council <br />for hearing at a regular meeting thereof on August 3, 1971 at <br />7:30 o'clock P. M. in the Village Hall of the Village of Lake Elmo, <br />pursuant to notice thereof published and posted as required by <br />law; and <br />WHEREAS, the Village Council has considered the matter <br />set forth in the petition as well as all other matters presented <br />to the Council at said hearing, and having given particular consider- <br />ation to the fact that the petitioners represent the substantial <br />majority of all property owners having property abutting the part <br />of the street proposed for vacation; that there was no objection <br />to said vacation by any person having property abutting on said <br />street; that each of the abutting property owners has granted to <br />the Village an easement for public utilities or drainage over any <br />land which accrues to him as a result of the vacating of said <br />street; and has determined that it would be in the interest of the <br />public to vacate that part of that street hereinafter described: <br />BE IT RESOLVED HEREBY that all that part of the street de- <br />scribed as "TWP. ROAD" in the plat of BERSCHEN'S SHORES which is <br />not now included within the right of way of the Village streets <br />known as Lake Jane Drive and Lake Jane Road, be, and the same is <br />hereby, vacated. <br />IT IS FURTHER RESOLVED, that the Village Council deems <br />a benefit to accrue to the Village by being relieved of any respon- <br />sibility for said part of said public street and the same is suf- <br />ficient consideration for the vacation thereof under the above <br />described conditions and said vacation is therefore ordered without <br />payment of any cash consideration by the property owners along the <br />
