0 <br />0 <br />M <br />@) <br />61 <br />M- <br />0 <br />0 <br />[o <br />R-72-2 <br />RESOLUTION <br />VILLAGE OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION AUTHORIZING TRANSFER OF ASSETS <br />TO METROPOLITAN SEWER BOARD AND EXECUTION OF <br />CONTRACT <br />BE IT RESOLVED, by the Council of the Village of Lake <br />Elmo, as follows: <br />1. Minnesota Laws 1969, Chapter 449, Section 5, Sub- <br />division 3, terminated the existence of the Northdale, East Oak- <br />dale, Oakdale and Woodbury Joint Sanitary Sewer Board (hereinafter <br />called W.O.N.E.) as of January 1, 1971, and vested in the Board <br />ownership of all assets and property owned by W.O.N.E. The <br />Village of Lake Elmo, as a member of W.O.N.E. had an undivided <br />ownership interest in such assets and property and also holds <br />legal title to the sanitary sewers described in Exhibit "A", and <br />permits, licenses, easements and other property rights necessary <br />for the location, operation and repair of such sanitary sewer, <br />for and on behalf of W.O.N.E. and its member municipalities. <br />The Mayor and Clerk are hereby authorized and directed to trans- <br />fer to the Metropolitan Sewer Board all right, title and in- <br />terest of,the Village of Lake Elmo in and to the assets and <br />property held by W.O.N.E. in its own name as of December 31, <br />1970, to the sanitary sewers described in the Agreement attached <br />hereto and to all permits, licenses, easements and other property <br />rights necessary for the location, operation and -repair of such <br />sanitary sewers or any sanitary sewers contracted to be built <br />by W.O.N.E. <br />2. The Mayor and Clerk are also authorized and <br />directed to enter into a contract substantially the same as the <br />one attached hereto fixing the amount owed by the Metropolitan <br />Sewer Board to the Village for debt service on bonds issued by <br />it and the other member municipalities of W.O.N.E. for acquisition <br />of facilities taken over by the Board. <br />Adopted by the Village Council this 1st day of <br />February, 1972. <br />Attest: <br />D nald Mehs'komer, Clerk <br />Calvin J. rookman, Mayor <br />
